Now Published: SCL(S) Protocol for the Use of Experts’ Joint Statements in Arbitration

Dear Friends, Colleagues and fellow members of the Society of Construction Law (Singapore) (SCL(S)),
One of the objectives of SCL(S) is to seek to contribute to the education, study and research in the field of construction law and related subjects, for the benefit of our friends, colleagues and other stakeholders in the construction industry and built environment sector.
A working group of the SCL(S) Thought Leadership committee was formed to draft the Protocol for the Use of Experts’ Joint Statements in Arbitration (Protocol). In 2024, an eminent panel at the SCL(S) Annual Conference was invited to provide comments to the draft Protocol. In 2025, SCL(S) invited members, and other stakeholder individuals, organisations and institutions to provide further comments. The working group has carefully reviewed the feedback and incorporated it where appropriate.

Why this Protocol?
Expert evidence is a cornerstone of construction dispute resolution. This Protocol is designed to be a practical benchmark for best practices, focusing on:

- Efficiency: Reducing time and costs associated with expert evidence.
- Collaboration: Enhancing the quality of joint statements to assist tribunals.
